According to the European directive of the European Parliament and of the Council of October 25, 2012, the CPE is: “a agreement between the beneficiary and the supplier of a measure aimed at improving energy efficiency , verified and monitored throughout the duration of the contract, under the terms of which investments (works, supplies or services) to this extent are remunerated according to a contractually defined level of energy efficiency improvement or another agreed energy performance criterion, such as only savings ”.

Who are the stakeholders in the Energy Performance Contract?

The CPE is a contract concluded between: 

  • on the one hand, a beneficiary : a company or community represented by a project owner who carries the project;
  • and on the other hand, an operator specializing in energy efficiency: ESCO (energy services company) or SOTI (third-party investment operating company)

It commits both parties to making investments enabling the reduction of the building's energy consumption. The operator is paid on part of the energy savings made. As for the beneficiary, he benefits from the financing of the work as well as its implementation.

In the event of over-performance, the profits are shared between the holder and the buyer according to a distribution defined upstream of the contract.

What is the content of the Energy Performance Contract?
